MET Eikaiwa Contract of Agreement

 1. Contract Overview
This agreement is made between the student (or the parent/guardian in the case of minors) and My Eikaiwa Tutor (hereafter referred to as “MET”). By submitting the application and completing payment, the student agrees to the following terms and conditions. This contract is governed by the laws of Japan and adheres to guidelines under the Consumer Contract Act and other applicable regulations.


2. Enrollment Process
(1) Trial Lesson
• A free or paid trial lesson will be conducted prior to enrollment to assess the student’s level and suitability for the program.
(2) Registration & Admission
• After the trial, the student must submit a complete registration form signed by the parent/guardian (for minors).
• Registration is considered complete upon receipt of payment for the registration fee, tuition, and materials.


3. Fees and Payment
(1) Registration Fee (One-time payment)
• ¥11,000/student, non-refundable.
(2) Facility & Digital Usage Fee (Annually)
• ¥5,500/student.
(3) Tuition Fees
• Tuition is charged monthly. The amount depends on the course enrolled.
• The first month’s payment consists of one deposit and an advance payment of one month.
• Invoices are sent electronically or by printed copy and must be paid within 7 days of issue.
• Late payments may result in suspension of classes or cancellation of enrollment.
(4) Materials Fee
• A ¥1,000 monthly materials fee is charged separately.
• Special event materials, educational apps, or other resources may incur additional charges with prior notice.
(5) Textbooks and Workbooks
• Textbooks and workbooks are not included in tuition and must be purchased separately unless otherwise noted.
(6) Payment Method
• Bank transfer and credit card payments are accepted. Cash payments are not accepted unless arranged in advance.


4. Cancellation, Withdrawal & Refunds
(1) Pre-Course Cancellation
• Cancellations made at least 5 business days before the course start date are eligible for a full tuition refund (excluding the registration fee) minus a service charge.
(2) Mid-Course Withdrawal
• Withdrawal must be submitted in writing using a “Withdrawal Form” by the 20th of the month prior to termination.
• Tuition already paid is non-refundable unless MET fails to deliver the course.
(3) School-Initiated Cancellations
• If MET cancels a course due to unforeseen circumstances, all related fees will be fully refunded.


5. Course Operation
(1) Attendance
• Students are expected to attend all scheduled classes on time.
• If a student takes a long break (up to 3 months), a “Leave of Absence Form” must be submitted by the 20th of the previous month to maintain registration status.
• Three months of leave without notice will result in automatic withdrawal.
(2) Make-up Classes
• Make-up classes may be arranged only for absences due to illness or emergency, subject to instructor availability, and must be requested in advance.
• Make-up classes are only held online for all courses.
• Make-up classes can only be taken within the term of absence.
(3) Tardiness
• Students arriving late must notify the school or teacher. Prolonged or repeated lateness may affect class participation and assessment.


6. Student Conduct & Discipline
• Students must respect instructors and fellow classmates.
• Disruptive behavior, harassment, or any act that interferes with lessons will result in disciplinary action and may lead to dismissal without refund.
• Parents/guardians must cooperate with MET policies for the safety and wellbeing of all students.


7. Student Safety & Guardian Responsibilities
• MET is not liable for injuries sustained during school hours unless caused by gross negligence.
• For minor students:
• Guardians must arrange drop-off and pick-up within 10 minutes before and after class.
• In the event of illness or injury, MET will contact guardians immediately and seek emergency care as needed.


8. Personal Data & Privacy
• MET will handle personal information in accordance with the Act on the Protection of Personal Information (APPI).
• Information will be used for enrollment management, communication, billing, and school-related purposes.
• Photographs or videos of students may be taken for school promotion (website, social media, printed materials). Guardians may opt out upon request.


9. Events, Excursions & Field Trips
• MET may conduct educational trips, excursions, and extracurricular activities inside or outside the school premises.
• Guardians will be notified at least one month in advance for off-calendar events.
• Event fees (transportation, entry tickets, etc.) are not included in tuition and must be paid separately.
• Participation is voluntary and requires signed consent.


10. Course Materials
• Materials provided by MET (excluding purchased textbooks) must be returned after the course ends.
• Lost or damaged materials will be charged at replacement cost.


11. Changes to Terms
• MET reserves the right to modify these terms and conditions with reasonable notice. Updates will be communicated via email or posted on the school’s notice board/website.


12. Governing Law & Jurisdiction
• This agreement is governed by the laws of Fuji City, Shizuoka Prefecture, Japan.
• Disputes arising under this contract shall be subject to the exclusive jurisdiction of the Fuji Summary Court or Shizuoka District Court.
